Last day to file claims in national mortgage settlement

ST. GEORGE – Tomorrow is the last day to file a claim to take part in the $25 billion national mortgage settlement that Utah and other states entered into with mortgage servicers in 2012.

The settlement arose when attorneys general of nearly all the states in the Union and the District of Columbia sued five banks for alleged misconduct. Utah’s former attorney general Mark Shurtleff said the banks’ misconduct “resulted in the issuance of improper mortgages, premature and unauthorized foreclosures, violation of service members’ and other homeowners’ rights and protections, the use of false and deceptive affidavits and other documents, and the waste and abuse of taxpayer funds.”

Bank defendants included in the settlement include Bank of America Corporation, JPMorgan Chase & Co., Wells Fargo & Company, Citigroup Inc., and Ally Financial Inc. (formerly GMAC).

According to the National Mortgage Settlement website, letters and claim forms were mailed in late September through early October 2012 to those borrowers who lost their home due to foreclosure between January 1, 2008, and December 31, 2011, and whose loans were serviced by one of the five mortgage servicers mentioned above that are parties to the settlement.
